Terms of service

The short version

  • Previews are free. Downloading a design costs 1 credit and unlocks that design for 7 days.
  • Credits are prepaid and never expire. Plans can be cancelled at any time.
  • Only upload pictures you have the right to use. You can use the files you download for personal and commercial work.
  • Always test-stitch first: results depend on your machine, fabric, stabilizer and thread.

This summary is here to help. The full text below is what applies.

1. About these terms

These terms of service (the "Terms") apply when you use the website stitchmypic.com and the StitchMyPic app (together, the "Service"). The Service is operated by Fleetiqo LLC, a limited liability company (LLC) formed in the State of Delaware, United States, with its registered address at 1130 Ogletown Road, Ste #2, Newark, DE 19711, United States, US Employer Identification Number (EIN) 38-4377244 ("StitchMyPic", "we", "us").

By creating an account or buying credits, you agree to these Terms. If you don't agree, please don't use the Service. Our Privacy policy, Refund policy and Cookie policy explain how we handle your data, refunds and cookies, and form part of these Terms.

You can reach us at any time at support@stitchmypic.com.

2. Your account

You need an account to save designs and download files. You can sign up with an email address and password, or, if you prefer, with your Google account.

  • You must be at least 16 years old. If you are under the age of majority where you live, you need permission from a parent or guardian.
  • Give us accurate information and keep your email address up to date: we use it for receipts and important account messages.
  • Keep your password safe and don't share your account. You are responsible for what happens under your account; tell us straight away if you think someone else has accessed it.
  • One person per account. Businesses may use an account for their staff, but credits can't be shared between separate accounts.

3. The Service

StitchMyPic converts images (PNG, JPG, WEBP and SVG) into machine embroidery files (PES, DST, JEF and EXP). The conversion runs in your web browser. Your original upload and design settings are stored on our servers so you can reopen and download your designs later.

You can upload pictures, adjust settings and view a stitch preview free of charge. The preview is our best simulation of the stitch-out; it is not a guarantee of how the design will sew on your machine.

Automatic digitizing works best on logos, lettering, clipart and artwork with clear shapes and flat colours. Photographs and very detailed artwork are simplified into a limited number of thread colours, and some images can't be turned into a good embroidery design at all. Please check the preview before you download.

4. Credits and payments

Credits are a prepaid digital service: each credit lets you download one design. When you spend a credit, the design is unlocked for 7 days, during which you can change its size, colours and settings and download it again in any of our formats as often as you like at no extra cost. After 7 days, downloading the design again costs another credit.

  • Credits never expire while your account exists.
  • Credits have no cash value, can't be exchanged for money (except under our Refund policy) and can't be transferred to another account.
  • Free credits, such as the credit you receive when you sign up or credits we add as a goodwill gesture, are a gift and can't be refunded.

Prices are shown on our pricing page and at checkout. Any taxes that apply are shown before you pay. Payments are processed by PayPal, which lets you pay with a PayPal account or a debit or credit card. We never receive or store your full card details. Credits are added to your account as soon as PayPal confirms the payment.

We may change our prices from time to time. A price change never affects credits you have already bought.

5. Monthly plans

Monthly plans (such as Hobby, Pro and Studio) add a set number of credits to your account at the start of each billing period, and renew automatically every month through PayPal until you cancel.

  • You can cancel at any time from Credits & billing in your account, or from your PayPal account. Cancellation stops future renewals; your plan stays active until the end of the period you have already paid for.
  • Credits you received from a plan stay in your account and never expire, even after you cancel.
  • We don't refund partial billing periods by default. See the Refund policy for the cases where we do refund.
  • If we change the price of a plan, we'll email you at least 30 days before the new price applies, so you can cancel first if you wish.

If a renewal payment fails, PayPal may retry it. If it still fails, the plan is suspended and no new credits are added until payment succeeds.

6. Right of withdrawal (EU and UK consumers)

If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from an online purchase without giving a reason.

Credits are digital content supplied immediately. When you spend a credit to download a design, you ask us to supply it straight away and acknowledge that, once the file has been supplied, you lose the right of withdrawal for that credit. We ask for your consent to this at checkout or before your first download.

Credits you haven't used yet are not affected: you can ask for a refund of unused credits within 14 days of purchase, as described in our Refund policy. To withdraw, simply email support@stitchmypic.com with your account email and the purchase you want to cancel.

7. Your images and your rights

You keep all rights to the images you upload and to the designs you create. We claim no ownership of them.

To run the Service, you give us a limited, non-exclusive licence to store, copy, process and display your uploads and designs, only for the purpose of providing the Service to you (for example, so you can reopen a design on another device). This licence ends when you delete the design or your account, except for copies kept for a short time in backups.

You promise that you own the images you upload or have permission to use them for embroidery, including for any commercial use you plan. In particular, don't upload trademarks, logos, characters or artwork that belong to someone else (such as sports teams, brands or cartoon characters) unless you have the owner's permission or your use is otherwise allowed by law. You are responsible for the products you make with the files.

If you believe content stored on StitchMyPic infringes your rights, write to support@stitchmypic.com with the details and we will look into it promptly.

8. Acceptable use

Please use StitchMyPic fairly and lawfully. You must not:

  • upload images that infringe someone else's copyright, trademark, privacy or other rights;
  • upload content that is illegal, sexually exploits minors, promotes violence or hatred, or harasses others;
  • try to access other users' accounts or data, or our systems beyond what the Service lets you do;
  • disrupt or overload the Service, or use bots, scrapers or scripts to use it in bulk without our written permission;
  • get around payments, credits or download limits, or abuse free credits (for example by creating multiple accounts);
  • resell or rebrand access to the Service itself, or copy or reverse-engineer it to build a competing service.

We may remove content that breaks these rules and suspend accounts involved in serious or repeated breaches (see section 13).

9. The files you download

The embroidery files you download are yours to use for any lawful purpose, personal or commercial. You can stitch and sell products made with them, use them for clients, or share and sell the files, as long as you have the rights to the underlying artwork (see section 7).

Machine and software brand names (such as Brother, Janome, Tajima, Bernina or Melco) are trademarks of their owners. We use them only to describe file compatibility; StitchMyPic is not affiliated with or endorsed by these companies.

10. Our software and brand

The StitchMyPic website, app, digitizing engine, name and logo belong to us or our licensors. These Terms don't give you any rights to them other than to use the Service as intended.

Parts of our software build on open-source embroidery projects, including Ink/Stitch. Those components remain available under their own licences, and nothing in these Terms limits the rights those licences give you.

11. Availability and changes to the Service

We work hard to keep StitchMyPic available and reliable, but we can't promise it will always be uninterrupted or error-free. We may need to pause it for maintenance, updates or reasons outside our control.

We improve the Service over time and may add, change or remove features. If we ever close the Service, we will give you at least 30 days' notice by email so you can download your designs, and we will refund the credits you paid for and haven't used.

12. Our responsibility to you

Embroidery results depend on many things outside our control: your machine and its settings, the fabric, stabilizer, needle, thread and hooping. Always test-stitch a design on a scrap of similar fabric before sewing it on a final garment or a customer's item. We are not responsible for damaged fabric, garments, thread or machines, or for lost production time, that result from sewing a design without testing it.

To the extent the law allows, the Service is provided "as is", and our total liability to you for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential losses such as lost profits or lost business.

Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for gross negligence or intentional misconduct. If you are a consumer, you keep all the rights that consumer law in your country gives you.

13. Ending your account

You can stop using StitchMyPic and delete your account at any time from your account settings. If you have unused credits you'd like refunded under our Refund policy, please ask before deleting your account, because deleted credits can't be restored.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect other users or the Service. Where reasonable, we'll tell you why first and give you a chance to fix the problem. If we close your account without you having broken these Terms, we'll refund the credits you paid for and haven't used.

14. Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. The date at the top shows when they were last changed. If we make important changes, we'll tell you by email or in the app at least 30 days before they take effect. If you don't agree with the changes, you can close your account before they apply.

15. Applicable law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the mandatory consumer-protection rules of the country where you live, and you can bring a claim in the courts of that country where the law gives you that right.

If something goes wrong, please contact us first at support@stitchmypic.com. Most problems can be solved quickly and informally.
